This privacy policy (this “Privacy Policy”) describes how Sophus Consultants. and our affiliates (“Sophus”, “we”, “our” or “us”) will collect, use, share and store your Personal Information that we collect in connection with your use of our website at https://www.Sophusng.com/ and any of its related or subdomains (the “Website”); in connection with your use of our platform/dashboard mobile software application and any other software application that we license (the “Platform”); where we act as the controller of your Personal Information (as such term is used in applicable data protection laws); and in connection with other occasions where we collect and process your Personal Information, as further detailed in this Privacy Policy.

For purposes of this Privacy Policy, “Personal Information” is information relating to an identified or identifiable individual. For purposes of this Privacy Policy, Personal Information does not include de-identified or aggregated information and, to the extent permitted by law, does not include publicly available information that is lawfully made available to the general public or information that is lawfully made available from government records.

This Privacy Policy does not apply to Personal Information collected from employees or candidates for employment with Sophus

Use of Blockchain

When using our services or products, certain information and data about the user may be stored on the blockchain in pseudonymized form and may not be deleted because it is not possible without deleting the entire chain. Such data stored on the blockchain will only be in pseudonymized form, including address (public key) of the user of the relevant services, a flag that the user is verified, a flag stating that the user is a sophisticated investor, a flag that the user has verified their bank account.

In this event and if such data is a Personal Data, the data processing by us is subject to Art. 6 (1) f. of GDPR based on our legitimate interest in using and providing this technology for our services in a functioning way.

Information collected from your browser or Device

We may automatically collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile phone, tablet or other device (“Device”) you use to access the Website. A Device Identifier is a number that is assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. We, and our third-party service providers may use a Device Identifier to, among other things, administer the Website; help diagnose problems with our servers; analyze trends; and track users’ web page movements over time.

In addition, we automatically gather and store certain information about your visit from your browser or Device, such as your browser type, operating system type, length of time on the Website, and how you got to the Website. We may collect this information through the use of server log files and other methods.

Information Collected using Cookies or Other Tracking Technologies

We collect certain information through tracking technologies used on the Website such as cookies (data files placed on a Device when it is used to visit the Website), mobile analytics software and pixel tags (transparent graphic images, sometimes called web beacons or tracking beacons, placed on a web page or in an email, which indicates that a page or email has been viewed, and which may tell your browser to get content from another server). We do this to analyze trends, track user movement around the Website, gather demographic information, and to generally collect information that we may find insightful or helpful. Certain web browsers may provide an option by which you may request your browser to inform websites you visit that you do not wish your activities to be tracked by cookies or other persistent identifiers, commonly called “Do Not Track Signals”. The Website currently does not respond to Do Not Track Signals.

We maintain an updated list of sub-processors, which is available to customers upon request.

No Sale of Personal Information: 

We have not sold your Personal Information to third parties, including during the twelve (12) months prior to the date of this Privacy Policy. We are not selling your Personal Information to any third parties for their own direct marketing purposes. We may share non-Personal Information, such as anonymous information or aggregate data, with third parties.

You may be entitled to certain rights relating to your Personal Information.  For example, you may be able to:

  • Request, once per calendar year, certain information regarding our disclosure of your Personal Information to third parties for their own direct marketing purposes.
  • Request, twice per calendar year, to know (i) the specific pieces of Personal Information we have collected about you; (ii) the categories of Personal Information we have collected about you; (iii) the categories of sources from which we collected your Personal Information, (iv) our business purpose for collecting your Personal Information; and (v) the categories of third parties with whom we shared your Personal Information.
  • Request to delete the Personal Information we have collected about you. We may deny your request under certain circumstances, such as if we need to comply with a legal obligation.
  • Request to correct the Personal Information we have collected about you, if you believe that the Personal Information we have collected about you is inaccurate.
  • Receive your Personal Information that you have provided to us in a structured, commonly used and machine-readable format and transmit it to other data controllers (data portability).

The Website is not directed to children under the age of 18. Sophus does not knowingly collect, use or disclose Personal Information from anyone under 18 years of age. If we learn that we have collected Personal Information from a child under 18 years, we will use commercially reasonable efforts to delete that information. TRANSFERS OF INFORMATION

 Given that we are an international business, our use of your Personal Information necessarily involves the transfer of data across borders. Sophus processes and stores data on servers in the United States. When we transfer data across borders, we do so in accordance with applicable data protection laws. For example, when we transfer data from the European Economic Area to jurisdictions that are not deemed to have an adequate level of data protection, we may use Standard Contractual Clauses. In the absence of an adequacy decision or Standard Contractual Clauses or any other right to transfer your data, we may rely on your consent as the basis for such transfer.

We enable you to interact with third party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We do not endorse and are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal Information from you.
